1. Agreement to Terms

Welcome to StoryPals! These Terms of Service ("Terms") govern your access to and use of the StoryPals mobile application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and StoryPals LLC ("we," "us," or "our"). Please read them carefully.

2. Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• If you are using the Service on behalf of a minor, you are the parent or legal guardian with authority to consent
• You will not use the Service in violation of any applicable law or regulation

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if we suspect any information you provide is inaccurate, fraudulent, or violates these Terms.

4. Subscriptions and Payments

4.1 Subscription Plans

StoryPals offers subscription-based access to premium features ("Subscription"). Subscriptions are available on a monthly or annual basis. By purchasing a Subscription, you agree to pay the applicable subscription fees.

4.2 Free Tier

StoryPals offers a free tier that allows you to create 2 characters and 5 custom stories (all time) to try the Service before subscribing. The free tier does not include premium features such as daily bedtime stories, unlimited characters, or advanced customization options.

4.3 Automatic Renewal

Your Subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You will be charged the then-current subscription fee, which may change with notice.

4.4 Payment Processing

All payments are processed through the Apple App Store or Google Play Store. Your payment method will be charged through your app store account. We do not have access to your payment card information.

4.5 Price Changes

We reserve the right to change our subscription fees at any time. We will provide you with reasonable advance notice of any price changes. Your continued use of the Service after the price change becomes effective constitutes your acceptance of the new price.

4.6 Cancellation

You may cancel your Subscription at any time through:

• Your Account Settings in the StoryPals app
• Your Apple App Store or Google Play Store subscription settings
• Contacting our support team at support@storypals.io

There are no cancellation fees. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. No partial refunds are provided for mid-cycle cancellations.

4.7 Refund Policy

We offer a 7-day money-back guarantee for new subscriptions. If you are not satisfied with the Service within the first 7 days of your initial purchase, contact us at support@storypals.io for a full refund.

After the 7-day period, refunds are handled on a case-by-case basis at our sole discretion. Refunds for purchases made through the App Store or Google Play are subject to their respective refund policies.

4.8 Fair Use Policy

Premium subscriptions include generous limits designed to accommodate normal family use. Current limits are:

• Custom Stories: Up to 30 stories per month
• Bedtime Stories: 1 bedtime story per day
• Characters: Up to 50 characters total

These limits are designed to prevent abuse and ensure fair access for all users. Typical family usage is well within these limits. If you have a legitimate need that exceeds these limits, please contact us at support@storypals.io to discuss your use case.

We reserve the right to modify subscription limits at any time to ensure the sustainability and quality of the Service. We will provide reasonable notice of any material changes to limits. Changes to limits will apply to new subscriptions immediately and to existing subscriptions at the start of the next billing period, unless otherwise specified.

We also reserve the right to restrict or suspend accounts that engage in excessive usage, automated creation, or other activities that may harm the Service or other users. We may implement rate limiting to prevent abuse.

5. User Content

5.1 Your Content

The Service allows you to create, upload, and share content including character descriptions, story prompts, images, and other materials ("User Content"). You retain all ownership rights in your User Content.

5.2 License Grant

By posting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

• Host, store, and display your User Content
• Process your User Content to provide the Service (e.g., generate stories based on your prompts)
• Use your User Content to improve our AI models and Service (in aggregated, anonymized form only)

This license ends when you delete your User Content or close your account, except where we need to retain backups for legal or operational purposes.

5.3 Your Responsibilities

You are solely responsible for your User Content and agree NOT to post content that:

• Infringes on intellectual property rights of others
• Contains personal information about others without their consent
• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Contains viruses, malware, or malicious code
• Violates any applicable law or regulation
• Is sexually explicit or inappropriate for children
• Promotes violence, hatred, or discrimination

5.4 Content Monitoring

While we do not pre-screen User Content, we reserve the right to review, remove, or refuse to display any User Content that violates these Terms or is otherwise objectionable. We may also report illegal content to law enforcement authorities.

6. AI-Generated Content

6.1 How It Works

StoryPals uses artificial intelligence (Google Gemini AI) to generate stories and images based on your prompts and preferences ("AI-Generated Content").

6.2 No Guarantee of Accuracy

AI-Generated Content may not always be accurate, appropriate, or suitable for your needs. You acknowledge that:

• AI-generated stories may contain factual errors or inconsistencies
• AI-generated images may not perfectly match your expectations
• We use content safety filters, but they are not foolproof
• You are responsible for reviewing all AI-Generated Content before sharing it with children

6.3 Ownership of AI-Generated Content

You own the AI-Generated Content created through your use of the Service. However, similar content may be generated for other users based on similar prompts. We do not claim ownership of AI-Generated Content, but we retain the right to use aggregated, anonymized data to improve our Service.

6.4 Parental Responsibility

Parents and guardians are responsible for reviewing all AI-Generated Content before allowing children to view it. While we implement safety measures, we cannot guarantee that all generated content will be appropriate for all children.

7. Intellectual Property

7.1 Our Property

The Service, including its original content (excluding User Content and AI-Generated Content), features, functionality, software code, designs, graphics, logos, and trademarks, are owned by StoryPals and are protected by copyright, trademark, patent, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

7.3 Restrictions

You agree NOT to:

• Copy, modify, distribute, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble the Service
• Remove or modify any copyright, trademark, or proprietary notices
• Use the Service for commercial purposes without our written permission
• Access the Service through automated means (bots, scrapers, etc.)
• Attempt to gain unauthorized access to the Service or related systems

8. Prohibited Uses

You agree not to use the Service to:

• Violate any local, state, national, or international law
• Exploit, harm, or attempt to exploit or harm minors
• Impersonate any person or entity
• Engage in any fraudulent, deceptive, or manipulative practices
• Transmit viruses, malware, or other harmful code
• Spam, harass, or send unsolicited communications to other users
• Interfere with or disrupt the Service or servers
• Collect personal information about other users
• Generate content intended to harm, abuse, or exploit children

9. Age Restrictions and Parental Controls

StoryPals is intended for use by parents and guardians to create content for children. Parents and guardians are responsible for:

• Supervising their children's use of the Service
• Reviewing all content before allowing children to view it
• Setting appropriate age preferences and content filters
• Monitoring their children's screen time
• Ensuring content is appropriate for their child's age and maturity level

10. Disclaimers and Limitations of Liability

10.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• AI-Generated Content will be accurate, appropriate, or meet your expectations
• Any defects will be corrected
• The Service will be compatible with all devices or platforms

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORYPALS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or malicious code transmitted through the Service
• Any errors or omissions in AI-Generated Content
• Any content posted by users

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless StoryPals LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

12.1 By You

You may terminate your account at any time through the Account Settings in the app. Upon termination, your right to use the Service will immediately cease.

12.2 By Us

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including if you:

• Breach these Terms
• Engage in fraudulent or illegal activity
• Violate the rights of others
• Fail to pay subscription fees
• Use the Service in a manner that could harm us or other users

12.3 Effect of Termination

Upon termination:

• Your right to access the Service will cease immediately
• Your User Content may be deleted (we recommend exporting it before termination)
• Certain provisions of these Terms (including indemnification and limitation of liability) will survive termination

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.

13.2 Dispute Resolution

If you have a dispute with us, please contact us first at support@storypals.io to try to resolve it informally. If we cannot resolve the dispute informally, any legal action must be brought in the state or federal courts located in New Jersey, and you consent to the exclusive jurisdiction of those courts.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Updating the "Last Updated" date at the top of these Terms
• Sending you a notification through the app or email
• Displaying a prominent notice in the app

Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and StoryPals LLC regarding the Service and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 No Partnership

Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship between you and StoryPals LLC.
